Stakelogic Must Pay Realistic Games €45,000 for Unlawful Use of ‘Book of Charms’ Trademark
The District Court of The Hague rules that Stakelogic has to pay Realistic Games €25,000 for breaching the settlement agreement over the Book of Charms trademark, plus €20,711.33 in legal costs. This is the end of the battle that lasted for several years.
The Conflict
Realistic Games released the Book of Charms slot in 2018 and trademarked the title. In 2019, Stakelogic rolled out the Book of Charms Quattro slot. Several months later, Realistic contacted its competitor demanding the game to be removed. And after the initial resistance from Stakelogic, the two signed a settlement agreement.
According to the agreement, Stakelogic had to stop using the Sign no later than 18 March 2022. Otherwise, the studio agreed to pay a penalty of €5,000 per day, but no more than €25,000 in total.
But even though the game was taken down, the developer continued to use the Sign on its website after the set date. When Realistic Games demanded the penalty to be paid, Stakelogic refused, and this time the case landed first in the Amsterdam court and then in the District Court of The Hague.
