Austrian Court Orders Casinos to Refund Player Losses. Malta Court Says the Ruling Is Not Enforceable

Austrians, who lost money playing on Malta licensed gaming sites, won the court case in Austria. According to the ruling, MGA operators had no right to provide their services in Austria. That’s why they have to refund players all the money they’ve lost.

Austrian rulings should be automatically enforced in Malta because both are members of the EU. But operators refused to issue refunds and contested the decision in Malta.

The Maltese court has recently decided that the Austrian court order cannot be enforced. The reason is that it breaches the EU rule that says that companies registered in EU countries have the right to provide their services across the European Union.

WH Partners, who represented gambling operators in Maltese Superior Court, called it a landmark decision. It shows that Maltese courts have the final say in such matters. The company didn’t reveal the names of the gambling operators involved, how much money was involved and any other details.
