Swedish Regulator Lost Appeal Against Zimpler. Working with Unlicensed Sites Is Ok
In 2023, Zimpler, which is a Swedish payment processing platform, was warned to stop providing its services to gaming operators that aren’t licensed in Sweden. The gambling regulator, Spelinspektionen, threatened to fine the company if they failed to comply. Zimpler disagreed, and the sides met in the court that ruled in favor of the payment company.
The regulator appealed the decision, but failed to convince another court. Gaming operators that hold no Swedish license should target Swedish players for them to be considered illegal. According to the court, the current definition of “targeting Swedish players” means that the site must be translated into Swedish. As long as they provide their sites in English, they are not considered to be targeting the country.
The court pointed out that the Gambling Act doesn’t provide specific details on what it means to target Sweden. It also criticized the regulator for lack of preparation and said there are no grounds for ordering Zimpler to stop providing its services to offshore gaming sites.
